Until recently, Ryan Pengilly worked for Serin Transport in Maddington as a dispatch coordinator, assigning jobs to tow truck drivers who work across a hour day. Mr Pengilly has accused the company, which has up to 60 workers, of underpaying him by engaging him as an independent contractor, rather than an employee. Mr Pengilly said the company told him he was "trouble making" and "not working as a team", and he was sacked earlier this month. He is among a number of workers being helped by the Transport Workers Union, which has accused Serin Transport of engaging in sham contracting. Serin has a strong tow truck fleet, and is a contractor to the RAC, which offers towing through its Roadside Assistance cover. That is despite them driving company trucks, wearing a uniform, being on a roster and having to apply for leave - common indicators of an employee relationship. Serin Transport told the ABC some of its workers were independent contractors, but denied engaging in sham contracting. In an email, the company said "Serin Towing and Recovery follow both the letter and the spirit of the law". Independent contractors have limited rights in the workplace. They cannot claim unfair dismissal and they are not entitled to sick leave, annual leave or public holidays.
